Terms and Conditions

1. Scope of application

(1) These General Terms and Conditions (hereinafter referred to as GTC) apply to all ticket purchases for the About Pop Festival 2024 (ABOUT POP) between Wirtschaftsförderung Region Stuttgart GmbH, Friedrichstraße 10, 70174 Stuttgart, represented by the Managing Director Michael Kaiser, and the ticket purchaser. The event is organized by Pop-Büro Region Stuttgart, a department of Wirtschaftsförderung Region Stuttgart GmbH. Wirtschaftsförderung Region Stuttgart GmbH is hereinafter referred to as Pop-Büro.

(2) Insofar as ticket purchasers are mentioned below, this also refers to visitors. The provisions for visiting the About Pop Festival 2024 also apply to them.

(3) The About Pop Festival 2024 offers events on Friday, 17.05.2024 on the premises of STR Kultur- und Betriebs GmbH, Quellenstraße 7, 70376 Stuttgart (venue) and the Impact Hub, Quellenstraße 7, 70376 Stuttgart (convention rooms), hereinafter collectively referred to as Wizemann Areal and on 18.05.2024 in the participating venues (club festival) as well as open-air events in the period from 17 and 18.05.2024. There will also be after-show parties at individual venues.

3. Ticket purchase

(1) Tickets are sold via the online store https://tickets.hoemepage.com/event/about-pop-2024-66eq51. In addition to these GTC, the order, contract and payment conditions stipulated therein apply.

(2) Admission is free for children and young people up to the age of 6. Discounted ticket prices are available for special groups of people. The provisions of the Act on the Protection of Young Persons in Public and the provisions for the admission of children and young persons set out in Annex 1 shall apply.

(3) The contract for participation is concluded upon submission of the order via the online form, after entering the data, accepting the GTC and clicking the »pay« button and subsequent payment of the fee. The ticket purchaser is obliged to pay in advance.

(4) After successful payment, the ticket purchaser will receive an electronic confirmation of the conclusion of the contract and his/her entitlement to participate.

5. prohibition of commercial resale

Tickets are only sold for the personal use of ticket purchasers. The commercial resale of tickets is prohibited, as is the purchase of tickets for subsequent use for advertising or marketing purposes, including use as prizes in competitions and other prize draws. In this case, commercial means any form of non-private resale or giving away.

7. Admission to the Wizemann area

(1) Children and young people are permitted access to the event area in accordance with the provisions set out in the ANNEX.

(2) The Pop-Büro reserves the right to restrict access to areas of the Wizemann Areal event site for safety and capacity reasons.

(3) Animals may not be brought onto the Wizemann Areal. Exceptions are assistance dogs for people with disabilities, which are marked as such.

9. Special access requirements and security checks

(1) It is prohibited to bring glass containers of any kind, canisters, cooler bags, other heavy containers, flares, pyrotechnic objects, weapons of any kind and other dangerous objects onto the event site or individual event locations. It is, however, permitted to take snacks (including snack cans, but not made of glass) onto the event site outside the individual event locations.

(2) Upon admission to the Wizemann area, a security check will be carried out by the security service for reasons of safety and order and to avoid waste. The security service is instructed to carry out a body search. The ticket purchaser agrees to this by purchasing the ticket.

(3) In the event of a breach of legal regulations or these regulations, access to the Wizemann area may be denied or an expulsion from the event site may take place.

(4) The Pop-Büro is entitled to refuse admission to ticket purchasers with a valid admission ticket for good cause or to expel them from the event. Good cause is deemed to exist in the case of behavior that promotes or glorifies hatred, violence or discrimination, in particular

 

– in the event of slurs or insults of any kind;

– wearing clothing or symbols with racist, anti-Semitic, violence-glorifying or other degrading depictions;

– wearing clothing or symbols that glorify or trivialize National Socialism or extremist and/or anti-constitutional ideas;

– Depictions and actions that violate criminal law provisions or are classified as anti-constitutional (in particular § 86 StGB – dissemination of propaganda material of unconstitutional organizations; § 86a StGB – use of symbols of unconstitutional organizations; § 130 StGB – incitement of the people; § 189 StGB – denigration of the memory of deceased persons);

– wearing medals and decorations of National Socialist organizations, even if they do not contain National Socialist symbols (e.g. badges of the Condor Legion and sleeve bands);

– wearing clothing or symbols relating to National Socialist organizations or organizations associated with the National Socialists, e.g: DJ (Deutsches Jungvolk), Harzburger Front, HJ (Hitlerjugend), KdF (Kraft durch Freude), LSAH (Leibstandarte Adolf Hitler), NSDFB (Nationalsozialistischer Deutscher Frontkämpferbund) and the Stahlhelmbund, NSFK (Nationalsozialistisches Fliegerkorps), RAD (Reichsarbeitsdienst), SA (Sturmabteilung), SS (Schutzstaffel), Waffen-SS;

– wearing clothing that is used by right-wing extremist groups as a distinguishing feature, e.g. CONSDAPLE, Erik and Sons, Hatecrime, Masterrace, Thor Steinar;

– when wearing clothing or symbols with references to extremist and/or anti-constitutional organizations, such as Blood & Honour, Bund Nationaler Studenten (BNS), Ku Klux Klan (KKK), so-called »Islamic State« (IS or ISIS), Skinheads Saxon Switzerland (SSS).

11. Requirements for attending the event and prohibited behavior

(1) The Pop- Büro and the venue may impose further requirements for access to the venue and attendance at an event on the basis of house rules and for security reasons. Such regulations result in particular from the house rules of the venue, notices at the venue, instructions from service staff or announcements on site. Please inform yourself about this in advance on the website and social media channels of the Pop-Büro and the venue and on site.

(2) The instructions of the stewarding staff must always be followed.

(3) Ticket purchasers must expect one or more of the following security measures for access to the event site and participation in individual events, e.g: Obligation to hand in bags, rucksacks and wardrobes at the customary local charges; carrying out body checks at the entrance; prohibition on carrying objects that could endanger third parties at the event; photography bans;

(4) So-called »stage diving«, »crowdsurfing«, »pogoing«, i.e. in particular climbing onto the stage, trusses or similar is strictly prohibited.

(5) Any commercial activity in the venues and in connection with the event on the part of the ticket purchaser is prohibited without the prior written consent of Pop-Büro.

(6) Any violation of these regulations that causes disruptions to the course of the event, damage to the venue, safety equipment or stage technology or causes a considerable nuisance or infringement of the rights of others shall entitle the Pop-Büro or the venue to expel the visitor from the venue or refuse admission.

(7) In the event of violation of legal regulations (e.g. commission of criminal offenses or administrative offenses such as assault, theft, drug dealing, setting off fireworks) or violation of these regulations, the visitor may be expelled from the venue. If this is made use of, the ticket loses its validity. There is no entitlement to re-admission or a refund of the purchase price.

13. Cancellation of the event and force majeure

(1) The About Pop Festival 2024 will take place in all weather conditions as long as the Pop-Büro can be held responsible for the weather conditions. If the weather conditions pose a risk to body and health, especially in the case of open-air events, the event will be canceled.

(2) Cancellation is also possible for other reasons of force majeure, due to official orders or court rulings, strikes, lockouts, operational disruptions such as fire and lack of raw materials/energy, obstruction of traffic routes and the endangerment of event visitors due to the misconduct of others or the threat of escalation due to large crowds.

(3) In the case that an event or the About Pop Festival 2024 is canceled in whole or in part due to the aforementioned circumstances and the Pop-Büro is not at fault, there is no entitlement to reimbursement of the ticket price or expenses already incurred. It is irrelevant whether the circumstances occur at the Pop-Büro or at a third-party company.

15. Choice of law

German law shall apply to the exclusion of the provisions of international private law.

2. Program About Pop Festival 2024

(1) About Pop is a festival and platform for a top-class, diverse and curated music program with international, national and local live acts that promotes new trends and talents. About Pop is a convention with and for actors, artists, enthusiasts and fans of popculture and pop music to discuss and rethink the issues of our time. About Pop links club culture, night-time economy and social coexistence and thus provides impulses for a city of the future. About Pop offers space for new theoretical discourses, collective approaches, cultural localizations, economic and social transformations and innovations, codes of youth culture, queer positions, inclusive projects, utopian narratives, social resilience, musical experiments and guilty pleasures. Together with the numerous cooperation partners and their diverse range of events at their various venues, the pre-sessions, after-shows and open-air events, the Pop-Büro aims to raise awareness of the diverse range of pop music and youth culture on offer and use the opportunity to open up new spaces.

(2) The Pop-Büro is free to implement the program as it sees fit. Any announcements regarding participants and acts are not binding and can be changed at any time. Changes to the line-up do not constitute a right of exchange or return.

4. Tickets

(1) With the purchase of a ticket, ticket buyers receive the right to attend the About Pop Festival 2024. The number of tickets is limited and takes into account the capacities of the venues. Due to the numerous venues, access to a specific event cannot be guaranteed.

(2) Tickets for the About Pop Festival 2024 are offered as festival tickets for both festival days or in different ticket modules for special event offers, which then only allow access to these events.

(3) Tickets are offered as digital tickets (download or mobile ticket). The digital ticket will be sent no later than the third working day after conclusion of the contract and receipt of payment.

(4) When downloading the digital ticket, the ticket purchaser prints out the ticket themselves after activation or saves it on a mobile device. The uniqueness of the ticket is ensured by a printed QR code, which is checked and validated upon entry to the event.

(5) It is the responsibility of the ticket purchaser to ensure that the barcode is legible at the time of access control.

(6) Tickets cannot be returned or exchanged. This also applies in the event of illness, non-attendance or other reasons. However, it is possible to pass on the purchased ticket via the ticket exchange of the provider; available via the link: https://tickets.hoemepage.com/event/about-pop-2024-66eq51.

(7) Admission to open air events is free. The Pop-Büro offers the payment method »pay what you want« for all those who wish to support the About Pop Festival 2024.

6. Admission and capacities About Pop Festival 2024

(1) With its events on Friday, 17.05.2024 on the Wizemann Areal and on 18.05.2024 in the participating venues (club festival) and the after-show parties in the individual venues as well as the open-air events in the period from 17 and 18.05.2024, the About Pop Festival 2024 offers a wide range of opportunities for attendance. Access to special events may only be possible with a special ticket.

(2) The capacity of the individual venues is limited. Therefore, a ticket only grants access to a specific venue until the capacity of the respective venue is exhausted. It is therefore strongly recommended that you arrive on time.

(3) For the aforementioned reasons, the ticket purchaser cannot be guaranteed admission to a specific venue. In this respect, there is no entitlement to a refund or partial refund of the ticket price.

(4) Admission is only possible with a valid ticket. The presentation of an order confirmation or an invoice is not sufficient.

(5) There is no entitlement to a seat or specific standing spot.

8. Access to other venues

(1) The cooperating venues are free to set their own rules for the admission of children and young people or may be subject to special legal regulations. Access to some venues could only be possible from the age of 18. Young visitors are therefore expected to inform themselves ahead of time about any access restrictions.

(2) The respective house rules of the event organizer apply to visits at a cooperating venue.

(3) Despite free admission, an admission authorization (e.g. wristband) is required for the marked open-air areas, which is issued at the entrance. Admission may be refused due to limited capacity. Ticket purchasers have priority admission. There is no entitlement to admission to the open-air event site.

10. Health, hygiene and infection protection regulations

(1) In order to prevent and avoid the spread of infectious diseases, the Pop-Büro or the venue may take special precautionary and protective measures. This will be indicated on site and on the websites and social media channels of the Pop-Büro. These instructions must be followed.

(2) The ticket purchaser is responsible for complying with the requirements of the Federal Infection Protection Act and any measures under state law.

12. Image recordings, prohibition of professional camera equipment

(1) Only small-format cameras and mobile telephones with a camera function are permitted at the Witzemann-Areal and in the other venues of the ABOUT POPFestival 2024. The recordings may only be made for private purposes and in compliance with the legal requirements, in particular compliance with the general personal rights of third parties and the right of portraiture (so-called Art Copyright Act). Any use other than for private purposes is not permitted. Please ensure that you use social networks carefully and only share the images in a private context. Otherwise, the reproduction is public and no longer private and is not covered by the permission and is therefore illegal.

(2) It is forbidden to take SLR cameras, cameras with zoom lenses or with video function of any kind, as well as video cameras and audio recording devices of any kind, such as tape recorders, MP3 recorders and dictation machines, without prior permission from the Pop-Büro.

(3) A security check will be carried out upon admission. The security service is instructed to carry out a body search and to remove professional camera equipment or deny access, unless otherwise agreed with the organizer or indicated by the press. The ticket purchaser agrees to this when purchasing tickets.

(4) Exceptions to these regulations apply in the context of press coverage, upon presentation of the press card.

14. Liability Pop-Büro

(1) Claims for damages are excluded. Excluded from this are claims for damages arising from injury to life, limb or health or from the breach of essential contractual obligations as well as liability for other damages which are based on an intentional or grossly negligent breach of duty by Pop-Büro.

(2) In the event of a breach of essential contractual obligations, the Pop-Büro shall only be liable for foreseeable damage typical of the contract if this was caused by simple negligence, unless it concerns claims for damages arising from injury to life, limb or health.

(3) The above restrictions shall also apply in favor of the legal representatives and vicarious agents of the Pop-Büro, insofar as claims are asserted directly against them.

(4) The Pop-Büro accepts no liability for lost, stolen or damaged items belonging to ticket purchasers, such as items of clothing, bags or valuables, unless the Pop-Büro or its vicarious agents are guilty of intent or gross negligence. Ticket purchasers must take care of their valuables themselves and protect them against damage, loss and theft.

16. Note on the dispute settlement procedure

The Pop-Büro is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The EU Commission’s platform for online dispute resolution is available at www.ec.europa.eu/consumers/odr.

The contract language is German.

 

Prices and fees

The total price and its composition and the statutory VAT included therein are displayed in the electronic shopping cart. Depending on the selected shipping method, payment method or ticket protection, different costs may be incurred.

 

Ordering and delivery area

The order and delivery area includes the Federal Republic of Germany and the entire EU.

No right of withdrawal

In accordance with Section 312g (2) sentence 1 no. 9 BGB, consumers do not have a right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services. Every ticket purchase is therefore binding and obliges the customer to accept and immediately pay for the tickets ordered.

ANNEXAccess for children and young people to the About Pop Festival 2024

For the protection of children and young people, the following access regulations apply to the event site

Children 7 to 12 years
Access only when accompanied by a person with parental authority

Children and young people between the ages of 7 and 12 are only admitted to the event if accompanied by a parent or guardian. Proof of authorization must be provided.

Exception: Young people aged 16 and over – unaccompanied access until midnight

Young people aged 16 and over are admitted to the event unaccompanied by a parent or guardian until midnight.

 

Exception: Young people aged 14 – 15 – unaccompanied access until 10 p.m.

Young people between the ages of 14 and 16 are admitted to the event unaccompanied if the event ends at 10 p.m. at the latest.

Children under the age of 7

– Access only to areas without sound and only when accompanied by a person with parental authority

Children under the age of 6 are only permitted to enter the event site in the outdoor area and the HUB and HAPPEN of the Wizemann area. Access is only permitted when accompanied by a person with parental authority. Access to the STUDIO, CLUB or HALLE rooms is not permitted. In order to be able to check access authorization, children up to the age of 6 must wear a visible wristband. This will be issued at the entrance.

Children and adolescents 13 – 17 years

– Admission only when accompanied by a person with parental authority or a legal guardian

Children and young people between the ages of 13 and 17 are only admitted to the event if accompanied by a person with parental authority or a legal guardian. A legal guardian is any person over the age of 18 who, on a permanent or temporary basis, performs educational duties on the basis of an agreement with the person with parental authority or who looks after a child or young person in the context of education or youth welfare (Section 1 (1) No. 4 JuSchG). Legal guardians must carry written proof of their appointment and present a copy of the identity card of the person with parental authority upon request.
